*UPDATE* Bailao Arrested For Impaired Driving

Toronto City Councillor Ana Bailao is in some hot water.

Toronto Police have confirmed to Newstalk1010 that the Councillor for Ward 18 was charged with one count of impaired driving and one count of over 80 mg.

Police say Bailao was pulled over at 1:47 a.m. Tuesday in the area of Harbord and Bathurst Sts.

While Bailao is not speaking to reporters about the matter, she has released a statement:

I can confirm that on October 16, I was charged with impaired driving.

This situation is regrettable. I have been advised by my legal counsel that because this matter is before the courts that I have no further comment.

Several councillors who have commented on the news are putting their support behind their colleague while the matter is before the courts.

"It's unfortunate," says Mayor Rob Ford. "She's innocent until proven guilty. That's the most important thing here. We've all made mistakes."

His brother councillor Doug Ford echoed those words when he joined Jim Richards on Newstalk 1010.

"Everyone goes through tough times," councillor Ford says. "Everyone deserves a second shot. Ana Bailao is a great councillor, a great person."

Councillor Ford says, "I'll stand behind her any day."

Several hours before councillor Bailao was stopped by police she was at the Mayor's Ball for the Arts. Councillor Michelle Berardinetti was also there.

"It's a serious matter. But with councillor Bailao we don't know what the situation is so we have to wait and see," Berardinetti says. "She has to come out and say what really happened."

Bailao will be in court on December 3rd for a first appearance.

    Is she a lefty, I don't know. I have not seen her in the news before either. I also have seen more heat on the mayor for being a dolt in his position being mayor, which is supposed to be the responsible role model others should follow.. now if we could find a responsible role model to vote for ...

    I agree, where are all the Ford Bashers now especially Adam Vaughan! Please Toby, don't even try dermoralizing Ford because of this person's actions. I don't hear Vaughan calling for her resignation with great indignancy. She was arrested for impaired driving, now she can drop her Holier than Thou act.

    Ummm! Sorry to say if this is a upstanding charge ride the wave many others have and deal with it.
    No sour grapes here but I was charged in 2008 with just over 80, not impaired driving and it has taken 5 yrs and thousands of dollars to deal with before it will finally be over insurance wise etc.

    Sorry to say several cases I know involving people who may have ties to resources the general public may not have may fall by the way side.

    Ok maybe some sour grapes here !

    It is you that really gets to my very poor nerve. The laws are structured to go after the poor the weak and blacks. This counselor by all standards is a conservative and in a The mayor’s camp, and let me state this today, this case is silly and it is not going to be heard from again for it Is going to be thrown out. Had this woman been black, the entire city would have gone all over her as a dirty shirt. Question yourself why Jerry Agar has not raised this issue today? And trust me I listened to him all day for I wanted to know how he will manipulate this one. Nope It never took place. A counselor drunk at a mayor’s function, did the mayor buy the drinks? Did he care to know who is drunk and not drunk let alone to know who can drive or not? Now imagine if a non-conservative counselor was arrested drunk, he would have declared city hall destroyed. Now this is what is frightening me as a black man in this city. The mayor has stated that she had a bad day……….” Well does this mayor know any black poor city dweller that has ever had a bad day and drove drunk? But when the mayor makes such a statement, when he is the overall manager, he pays the Police Officer that arrested, he pays the prosecutor, he pays the judge, he pays the guards, who can go after this woman? Enjoy this case for this is the last day you will ever hear about it. A couple of months ago there was a Police Officer arrested on DVP in a morning drunk and driving, can you tell me what happened to that case? No you cannot for it will never ever be heard from. And that is why it is so comforting to some of us from Africa that have lived in this city as long as I have, for we understand how democratic Iddi Amin was, for this is what he was doing, he protects his own people. In a civilized democratic society poor and black people with Natives get arrested for drunk driving, talk radio stations as CFRB go after them but if you’re rich and if you’re a conservative you are a free bird. Only that Iddi Amin failed to understand that serving in such autocratic system you have to talk and talk much by owning radio talk shows.

    It is the hypocrisy that gets to my silly nerve.

Did you not read it thorugh she was busted 4 ours after leaving the Mayor's dinner. It has nothing to do with race, color or creed! As for the Polioce Office arrested on the DVP for impaired EXACTLY! he was arrested and when it goes to court it will be reported. Please get a life and stop with blaming the world for everything.

    Councillor Bailao demonstrated very poor judgement in choosing to drink and then drive. At the press conference she showed NO remorse nor accountability for her own actions that resulted in two serious criminal charges, for which she will plead "not guilty".

    I don't know WHY our so called "leaders" can't recognize the importance of being held to a higher standard, rather than the lowest common denominator ~ then act accordingly. I want to know that the politicians we elect will be using GOOD judgment on matters involving Toronto, and not BAD personal decisions. Because it reflects badly on the whole city, and seriously diminishes my respect for them, as a tax payer, and citizen. And it's worse when cllrs who are the first to 'squawk' are strangely silent, while others rush to her defense!

    I'm glad the police didn't let her off, as so often happens. But I want to know that her lawyer, court costs and fines WILL NOT BE PAID BY THE TAXPAYERS!! I want to know that Cllr Bailao will be held fully & financially accountable for her own actions, funded through her own bank account and not the public trough!! Nobody else gets bailed out by taxpayers for their errors in judgement, errors of omission and criminal charges like this. So this councillor, and all others who break the law, should not be getting a free ride on the gravy train!

    Mayor Ford promised full transparency & respect for taxpayers, so that's what we expect. Cllr Bailao failed to take a taxi when it was a justifiable expense, made a dumb decision, then failed to take responsibility when she had the opportunity to admit fallibility and even demonstrate some humility. She blew it, so now she alone must suffer the consequences.

    I will donate 300 dollars to a charitable organization decided by members of the Jerry Agar’s listening group if this woman ever gets found guilty. If you ever hear of this case again anywhere that this woman has been in front of a judge and she has been found guilty remind me to walk to CFRB during Jerry Agar’s show and I will have a 300 dollars check in my hands to be deposited into an account of an organization so decided by Jerry Agar’s listeners. This system was so built to be so anti poor people, anti-blacks and anti-Natives to a level that I can raise such a bet today. I am in Toronto watching and listening to Jerry’s program just remind me to where you need the money. Some of us have lived under this duress all our lives way long to learn how this society functions.

    If you are poor, black, not conservative, grow up and shut up.

There is no division so, please stop with your whining about the way things are because here in Canada things are great. What was it like where you came from and why did you settle for Canada if it is so bad here? Nobody lives under any abnormal duress here because of the way they are treated by Government, Police or society in general. Please stop blaming Canada and society for your whoes. Ana Bailao was arrested for impaired driving, plain and simple, the police did not play favourites with her. let's see how it turns out. Now stop pointing fingers at Ford and everyone else you can think of. I'm sure Adam Vaghan is one of your heroes.

    shes innocent untill proven....give me a break, she was given all the proper tests for impaired driving and failed, if she is going to hire a spin doctor and some of her deep pocket buddys make some phone calls, she will get off free, not one of the other councillors were at any of there constituents bail/court hearings if evenr anyone of them was chat=rged with such an offense, they run to her and not to no one else, what a dispicable display of solidarity, these people should resign and the accused bailao, should resign immediately and perhaps get a job somewhere else, this is a criminal matter that she has been charged with and no criminal can/should hold a public position/office, these are people by the way that push/pass policy in our city/province and they do not know right from wrong, shameful, if any of those councillors that showed up on her behalf were there on the taxpayer dime, eg. time, gas, driver, lunch...any expenses, they should recompense there wright offs immediately and the mayor ford to investigate, she need to go, no if and or but....until proven guilty...lol,....she is guilty, what dont you get??? shameful, dispicable by all

      @matt why has this topic died and why has this turned into a race/color debate???? i would like to know why no one has acted in regards to those councillors that stood by her, what has the mayor done/doing, what have they done thus far??? if these people condone such an act, i am open to believe that these very people themselves are open to or have done similar acts in the past and will continue do so in the future. Im afraid that these very people look upon criminal acts such as bribery, fraud/theft, perjury,conspiracy....etc as acceptable and are capable of comitting them at anytime. Immediate resignation should have already taken place but we are not dealing with ethical people, so dismissal by a superior is in order. Those superiors are ulitmately the citizens/taxpayers of toronto....shame

    There was an accident on Bay and Bloor where Michael James Bryant had an altercation at 9 45 pm with a cyclist identified as Darchy Allan Sheppard. Bryant dragged Sheppard on a street as he was driving on the pavement to get him and lastly dragged him by his rear tires and killed him. Do you have it on any record that Bryant took a breathalyzer that night for Police to understand if he was drunk or not? Second question, do you know of any incident where a man black as my self-drives in the night in Toronto, and kills someone and he/she does not take a breathalyzer? The answer is no for testing for alcohol is a standard procedure in an accident especially when there is a fatality.

    Why wasn’t one taken at this accident?

      @Edward Mulindwa No, I don't have it on record that he took a breathalyzer, but the details of that night are murky at best. If anyone is driving and is involved in an accident they are given a breathilyzer IF the driver is supected of drinking. The incident with Bryant and the cyclist was unfortunate, but there was blame on both sides from all accounts. The point is Ana Bailao was arrested, the officer did his due diligence and arrested her and gave her a breathilyzer and subsequently charged her. Her position as a Councillor didn't cuury her any favors with that officer. Please stop saying that we Canadians are racist and every ethnicity othe than whites are treated unfairly. This is wrong, wrong, wrong and I am personally getting very, very tired of it. Canada is a wonderful country, that's why you are here isn't it?

    Months ago, we had a mayor by the name of Mel Lastman, his official wife went to The Bay and decided to steal a knicker for herself. Police was called and she was arrested. Although she was arrested with the stolen nicker she was not charged. The nicker was returned to The Bay and she went home. Do you know of a wife of a poor Canadian, a black man or a Native in this society that can walk to The Bay and steal knickers for herself, Police get called in and charges are not laid, the nicker returned to The Bay and she walks home?

    3. As I remember the story - Ms.Lastman was known to have some mental health problems at the time - and - many people with no great criminal record - and the same issues - are DAILY given the same breaks by the legal system (which I make a living in).

    4. Having been to most of the P.O.A. (Highway Traffic) courts in and around Southern Ontario - I can attest to the fact that the traffic courts are not filled with a seeming disproportionate number of Black Canadians.

    5. AGENDAS - which Mr. EdwardM_8180 HAS - I tried to read his over 70 posts here - but after the third or fourth - I stopped - the theme is the same. RACE RACE RACE.
    Sir - 1837 - almost 40 YEARS before the U.S. - Black Canadians - GOT THE VOTE. Sir - the Underground Railroad stopped here - and many stayed here.

    Yes I have read your writing and it is very interesting for as Barb very clearly illustrated, you have never lived into a skin of an immigrant in this society to know what we go through. So I do not event think that you are in position to stand up and make judgments. I am surprised that you claim that MS Mel Lastman had mental issues, for those of us that follow issues in this city closely know that people with mental issues just get shot by Police and die and for real. We are at a level where Doctors have clearly stated that they are not willing to call Police if a mentally affected person causes a problem because Police is only going to shoot him dead. Now if you claim that she had a mental issue and she survived Toronto Police, it becomes very interesting. And just on record, for I know you’re going to come back to me with so and so was standing on a street with scissor so the Police Officer’s life was in danger and he had to be decapitated. Let me inform you that a prisoner escaped from jail and got a gun, he broke into a house on Avenue Rd and Eglinton, and Police showed up and arrest him with his gun. Why can they do that? For they are trained to. When you look closely at all Police killings in this city they have not killed anyone with a gun but they have all been arrested, they only kill those with a hummer a knife a pair of scissor, one wonders why.

    But let me go to the issue of our irks fan racism. No we actually do not fan it but we raise issues that affect us as immigrants/Canadians in this country. This woman drove drunk and I stand that she is not going to be treated as any other Canadian due to her stature and money. And that message keeps on going out only that as you see society fighting school bullying today, we also get bullies as Barb who stands up and ask a simple question, why don’t you leave Canada and go back where ever crap you came from? I have lived in this country way more years than I lived in my country, but to today to Barb I’m not a Canadian enough and if I see something wrong I should take Air Canada out. And it is not only Barb but a big Canadian society believes in her racist. I flew into Pearson and a kid, an immigration officer, I call her a kid for she was younger than my first born and I would easily have been a father to this kid, but she asked me a simple question “So how did you get a Canadian Passport?” Of course she would not ask that question to Barb for she is white. And I honestly responded to her, I told her that I went to a building with words Immigration and citizenship passport office put in a couple of forms and photographs and got it. What did you want me respond to a stupid question? I love this country, but I think it is my job as a Canadian to build it to a better country and complaining about something wrong is a way to change it, can you imagine if Barb flew into this country God knows from Ukraine or Northern Island and every complaint she made the Natives told her to pack and leave? This country would not be what it is today. And what the Barbs forget is that very and very shortly this game is going to be over for we will beat them by numbers and they will become minority in this country. Then what will you do?

    So when she goes on with this country is fair to everyone, I refuse that nonsense, and here is a very good example for I love to go after a point with an example. I want you to go to Sherburne street, drive from Charles street and south. Look at how silly that street has been done in making a path for bikers, it is ugly it is dangerous and it has a hump on each side of the street. Let me put it this way to you sir, Sherburne street is the only street in the entire city of Toronto that has a hump on both sides. And why did they do it that way? For Sherburne street is a street of poor people and no one can stand up to complain. Remember what Mike Harris did, he again started with Wellesley Hospital and he shut it down for the users are poor and not mater. Now city politics changes by radio talk shows going after bad things done by the city. Do you think Jerry Agar can comment on Sherburne street? No for no one living on it that really matters in the bigger picture. They are poor and in TCHC and we can experiment with them. If they constructed your street as they have done Sherburne street you would have been up and in arms. Now you have a city lead by the conservatives, radio stations controlled by the conservatives, Federal government controlled by the conservatives, and on the silliness the Liberals have played the province controlled by Hudack. So everything is conservatives, go figure the people’s fate.

    And yet we cannot even raise this issue for Barb a more God created Canadian than all of us stands up and demands that we leave for now she is a more Canadian than the rest of us. The single reason most of American immigrants use this country to come to North America, is because American racism is open and straight, the one of Canada is so hidden that the Barbs of today claim how society is treated equal, but when you go to apply for a job she has, she looks in your eyes and with that very plastic smile goes “ Oh I have read your resume and it is very impressive, but I cannot give you this job for you are way over qualified for it” Toronto today has the most educated taxi drivers in the entire world, brain surgeons driving cabs in agony, what does that tell you? You rather stand up and tell me that I am black or Indian and you do not need me, for this is why our kids have ended up in crime for society believes we are the problem so it does not matter what I do I am a criminal anyways.

    It is strange that you do not read what I write but you respond !!!!!!!!

I can't believe that a forum about a city councillor being arrested for impaired driving has turned into this. And just for the record, I mades no such statement that "you leave this country and go back to the crap country you came from".       Of course no I do not know you and a very reason I only respond to you with specifics, and direct examples with what I see going wrong, and responses than asking you to pack up your things and leave this country as the only true God born Canadian Barbs. And remember that as much as we try and so hard to raise these issues, many of Canadians are the Barbs kinds of reasoning to a point that I can be surprised if you are not one of them.

      My living in this country is so long that I do not find that reasoning strange any more.
