Darwin's owner plans public support rally

Posted By: Michelle Rosa · 12/19/2012 6:47:00 AM

A couple weeks ago, Darwin the monkey made headlines worldwide after he was found wandering the parking garage of an Ikea store in North York and very soon, his former owner will fight to get him back.

Yasmin Nakuda's lawsuit goes to court on Thursday.
She alleges that the Story Book Primate Sanctuary in Sunderland unlawfully detained her monkey.

She's also naming Toronto Animal Services in the lawsuit, claiming they had no right to take Darwin away from her that day. Nakuda alleges she was tricked into handing him over after being threatened with criminal charges by animal services.

On Wednesday, she will hold a public support rally in front of their North Region office on 1300 Sheppard Avenue West.

Fifty Seven percent of the Newstalk1010 poll votes favour returning Darwin back to his human Mom as of 1 PM, Wed, Dec 19th.

Animal Services overstepped their authority in seizing this pet monkey, and should release him to his owner pending the outcome of the lawsuit. This baby monkey has a bond with Jasmin Nakuda who is for all intents and purposes the only mother he knows and both are being wrongfully separated to what end? Darwin is not a public safety threat and Jasmin is not abusing him.

It would be a greater offence by TAS to remove him at this point, where he remain confined elsewhere, in a cage, which is NOT "the natural environment for this species either. This is the same argument they used to illegally seizie her "property". The by law restricting ownership of an exotic species has been enforced through the $240 fine which Jasmin paid,. So the monkey should have been returned to her with a conditional period of time allotted for her to either move away , re-home him elsewhere or counter file in court. Even in the eyes of the law, this monkey is HER property.

What bothers me more than all of the above is the fact that NOBODY has voiced concern about the ILLEGAL import/export trade bringing such exotic (baby) animals into Canada & the GTA ~ with impunity! Why is the monkey "breeder" who sold Darwin NOT being charged with this even greater offence? These animal traffickers are the most offensive greed driven criminals who MURDER the mothers of such infant monkeys in order to abduct their offspring!! Why isn't TAS investigating & charging THOSE people??

They have been overzealous in killing innocent cats & dogs in their shelters (aka DEATH camps) while spying on pet owners to enforce licensing fees, and UNJUST by laws such as BSL (Breed Specific Legislation) against pit bulls who have never even committed any offense! TAS staff seem to prefer to do NOTHING rather than being actively engaged in the most basic duties.

Things like educating the public, spay/neuter, foster/adoption programs, feral cat populations and going after those who are repeatedly neglecting , abusing, poisoning, shooting, killing pets & wildlife. What have they done about the long overdue transfer of the 3 elderly elephants suffering at the Toronto Zoo, another example of exotic species who are NOT in their "natural habitat".

Why is TAS so negligent in monitoring & enforcing fines for blatant circus animal abuse and for violations of livestock transportation regulations, allowing the sale of kittens & puppies from horrific MILL operations (against Toronto by laws now), not investigating & charging those involved in dogfighting rings, pet theft? Why can't they keep proper lost & found pet records & follow up, and generally clean up their OWN negligence in their duties & responsibilities? Even their euthanasia is INHUMANE with a heartstick rather than putting an animal "to sleep" peacefully.

Why is Newstalk1010 and other media sensationalizing the IKEA monkey incident and NOT reporting all of the above? Give Darwin the monkey back to its mother, and do something about the REAL animal violators. (SEE LISTED ABOVE)
