Clayton Ruby: Rob Ford must go

The lawyer who brought the conflict of interest case against Rob Ford says the decision to boot the mayor from office is justice served.
 
Clayton Ruby spelled out his argument in a document he filed with the courts on Christmas Eve, in preparation for Ford's appeal hearing on January 7th.

In the document -- called a factum -- Ruby argues the only way to punish a public official who breaks Toronto's rules on conflicts of interest is for that person to lose his or her job.

Ruby also says Ford's legal team has not demonstrated that the mayor's actions fit into one of the Municipal Conflict of Interest Act's exceptions.

He goes on to attack the case that Ford’s lawyer will present at the appeal hearing, one that argues Justice Charles Hackland made 4 errors of law when he ruled on the decision that ordered his client out of office.

Ruby has asked the court for the appeal to be dismissed, with costs.

    Clayton Ruby is a slimeball and this witchhunt against Ford was started by a leftie looking to get Ford out of office. However, Ford could have read, understood, and followed the rules and none of this would have happened. I hate to admit it but it was Ford's own incompetence and laziness that put him in this position.

      Ruby and the "leftie conspirators" are exactly as you stated.
      And ... Ford needs to be punished to the extent the law allows, not just for the fact that he knew he was in a conflict of interest, but for his "in your face" attitude about the legislation itself.

    Conflict of interest? How come it doesn't apply for lawyers? It should apply. We would have a LOT fewer parasitic lawyers sucking the life out of society for their "interests." Let them go 'practice' in a place without elections. They don't seem to understand what elected by the people means. Leftist, socialist, commie media and lawyers think they should be running the country, province, cities. Screw what the voters decided. Miller was the worst Mayor in history but did the right whine and contrive and plot? No. They sucked it up and waited. Now - they have to do so much to fix the mess he made. What a loser.

    mr ruby, and his ilk forget the Mr. Ford was voted in by the people! That the issue pending , Mr. Ford did NOT benefit from in anyway, financially! Because the elite of the council, don't like the physical image Mr Ford presents and see him as a buffoon, as another poster said.. Suck it up! Mr. Ford has done plenty , in his position as mayor, to come through with promises he made during his election!

It doesn't seem to matter to The people who are delighted with Rob Ford's dilemna and the fact that Mr. Ruby made this announcement on Christmas Eve, just in time to make Mr. Ford's Christmas a little less Merry and it doesn't seem to matter to people like Douglas who finds anything anyone says against Mr . Ruby offensive, but you never hear any of these people saying that it is crass and demeaning to say that Rob looks like a crackhead and his brother is an inbred, or that Rob is a buffoon, or just downright making fun of his appearance and him in general. Obviously the Fords and the people who support them are crass and not elitist enough. What a joke!

    Mean spirited, petty little men dream up mean spirited, petty ways to make the lives of people they don't care for miserable and as an added bonus get their names plastered all over the media with some people even heralding them as heroes. We all know that isn't true though, not a hero among this mealy mouthed, snacatamonious, contrived bunch of lynchers. They have the lynch mob mentality, because they certainly have a lot of mean spirited lynch mob mentality followers. I can't wait for Ford to make a huge come back and he will and I hope he takes away more perks and deals with the unions unafraid.

    That is a very childish argument. So why don’t we take a next step. Let us fire the lawyers, let us close the courts, let us fire the Police Officers and let us take out all bad laws like conflict of interests. Well why do we need all those services when politicians get elected by a democratic vote !!!!!! Let us open it all up for when you are elected you get a free ride. And it is very strange for one of those days you will get a very terrible mayor and you will wallow back into the laws to keep him/her in line. That is why you do not become selective in implementing the law, but make it fair for everyone. Whether the mayor was wrong, whether he should be found guilty, that is an argument for the courts to decide, but calling for his innocence for he was elected by the people, is way shallow childish uncalled for and out right plain stupid.

    Unbelievable.

    Very well put, then we change the law. We do not argue that we cannot sue this man or woman for he or she was elected by a majority, who is next to be excempted? We always write, change, amend and fix the laws. But we enforce them uniformly.

      2. to your point about uniform enforcement, ever heard of caledonia and the current native protest on the railway?
      3. talk to a lawyer sometime to become educated on the fact that uniform enforcement is a pipe dream. If it were uniform jack layton would have had the same punishment as the others caught in the raid on the massage parlor, as it has been reported
      4. the rule that got him caught is a perfect example of the saying "the law is an ass"

    And you think I do not know that? Yes I know it. Here is an example. Mayor Rob Ford was photographed driving when reading a stack of papers, he was not charged and The Police stated very fast that reading while driving is not an offence. 3 questions for you, {1} Do you know how many drivers that have been ticketed for reading while driving? {2} Had you driven while reading that stack of papers would have you been ticketed? {3} Where did Barb post that the Police should have charged The Mayor then? Now that when they charge him wrongly she stands up. To tell you the whole truth, I was surprised that Jack Layton was never charged, it made me trust “the system” more. On your the punishment does not fit the crime, I do not care if Rob Ford remains the mayor or if he is thrown out, politicians are all the very same. Conservatives in Ottawa are spending way worse than the Liberals. Why did we even take an election? Did you know that President Obama facing the economical cliff signed an executive order on 27th December when everyone was on vacation and he ratcheted up his salary his vice and all the senators? Total cost for that increment about 12 Billion dollars only. So it is not Rob Ford it is politicians.

    The rest of it is in our brains man.

      @EM As usual your arguments are ridiculous and way off course. This is Canada, Obama is in the US. As far as charging the mayor for reading and driving, the police did not catch him in the act. Conservatives spending more than the Liberals, they have a long way to go.

      @EM to your point about reading and driving, it's possibly an example of another stupid law. If the idea is to stop distracted driving why only mention texting or talking on handheld phone as opposed to a catch-all that would cover a wider net?

      as to the conservatives spending more you are correct when they first came to power. Part of that was stimulus spending to keep the economy humming after the 2008 debacle. Part of it was also wasted. Since their majority they have not spent more (when you account for natural population growth and inflation).

      no one is perfect; we can only hope to choose those who, on balance, will do a better and more responsible job for our city, province and country

    The argument is not if the Police catch the mayor in act, The argument is in the statement that Police made. The law as it was written it isnot illegal to read while driving. Look I am a very faithful listener to CFRB please. I repeat myself for your clarification please. I am not arguing that the mayor was not charged, I am arguing that surprisingly Police made a statement that driving while you are reading is not illegal as by the law that was instituted in Ontario. Why do you think that entire noise settled very immediately? No one should be arrested for he/she is driving while reading. That is by the Toronto Police. Geez !!!!!!!!

    Please understand what I am arguing about before you bolt.
