*IN DEPTH* Ford Wins Appeal to Remain in Office

Posted By: Newstalk 1010 · 1/25/2013 4:38:00 PM

Rob Ford has won his court battle to keep his job as mayor of Toronto.

A Divisional Court panel today struck down a previous ruling that Ford should be dismissed from office for violating conflict of interest rules.

The three-judge panel agreed with Ford's lawyers, who had argued the previous ruling was legally flawed and their key finding was that council did not have the authority to order Ford to repay donations.

In November, an Ontario Superior justice ordered Ford removed as mayor for taking part in a council vote that he repay $3,150 raised for his private football foundation.

The ruling was put on hold pending today's decision.

``This has been a very, very humbling experience,'' Ford said hours after the decision was released. ``I have enormous respect for the judicial system and I'm very, very thankful for the decision it made today.''

Clayton Ruby, the lawyer who challenged Ford lamented the decision as ``disappointing,'' saying Ford got off on a technicality.

Ford vowed Friday to work hard during the remainder of his term and suggested he would run for re-election, saying he would ``spend the next six years on getting the job done.''

But Friday's decision may not mark the end of his legal woes.

``We believe that there are serious errors of law in the judgment and we will ask the Supreme Court of Canada for leave to appeal to that court,'' Ruby said in a statement.

``It must be acknowledged that such appeals are not easy but this remains an important issue for all citizens.''

An audit of Ford's campaign expenses is also pending.

Well, the 3 judges ruled in his favour, so everyone has to live with that based on this part of the Ford story.

Can't wait to see the name calling in the comments section that is surely to come ;)

@jack I am sure most 1010 listeners don't realize their every man is very wealthy and got away with raising money using some other "corporation's" letter head to raise money for his personal charity

@Sonny Yadda, Yadda, Yadda....Give it up and while you're at it look at McGuinty and the complain about what someone got away with. Ford won his appeal....deserfvedly so....now deal with it...He's tha mayor and the rest of those yahoos aren't.

@jack McGuinty stepped down after serving 22 years not raising money for his charity but maybe for his political campaigns. Ford's not a very honest mayor because you conservative types usually use the bluster and argumentative topic changes...

@jack unlike you Jack. If he lost you would of been all over here calling the judges left wing and all that B.S.
i'm not going to bring myself down to your level and call the judges names. decision was made. you respect the decision of the judges.
See Jack that's how intelligence works.
let see if he makes it to the middle of Feb without getting kicked out for cheating on his campaign finances.
Jack i never ever wanted him to get kicked out. really i didn't .
i want the voter to decide. I think Rob is a good community guy but a diphead as a mayor with an idiot brother and their sideshow stuff. that's how he gets in all this trouble.
If Rob is wise he comes with a different attitude and less sideshow calling others names who he doesn't like or agree with their politics and such because they'll fire back at him. But something tells me he's not that wise and the sideshow will continue and the city will keep on being worse for it.

Jack you forgot the "e" on made. your welcome!

@Stug Sorry about the e not being on the end of made, I thank you for pointing that out. Yes I realize how intelligent respectful you are, I have read a few of your despicable remarks. Now run along Stug, you and your buddy Adam lost. Adam nust be assembling his noose right about now. I bet he was sooo positive that Ford would be out! It's a good day for Toronto.
