Clayton Ruby Will Appeal to Supreme Court in Ford Ruling

Posted By: Newstalk 1010 · 1/25/2013 11:37:00 AM

Lawyer Clayton Ruby, who is representing Paul Magder, called it a 'technicality' that lets Rob Ford stay in the Mayor's chair.

In a release, Ruby says it's disappointing, and he believes there are serious errors of law in the judgment and he'll be asking the Supreme Court of Canada for leave to appeal to that Court.

He goes on to say, 'especially troubling is the finding that if a politician raises money from lobbyists and directs that money to his or her own personal interest, such abuse is beyond the reach of government oversight.  This raises the possibility of American-style Political Action Committee (PAC) fundraising, which should be of great concern to all Canadians.'

Why don't you just leave it alone, and put it to rest! IMO, you couldn't give a hang about this technicality ... Hope you and Mr. Madger, will be gracious, and pay Mr. Ford's lawyer bills, which he wouldn't have if it were not for you both. Mr. Ford did NOT gain any profits over the monies that went to his football team!!. Also, with all due respect, if you feel you can work complimentary, there are many more serious issues and people who cannot afford your expertise , that you might help out!

    Let it go.

@Nick I'd say this to Clayton:

Since you want to appeal the recent Rob Ford Court Decision to a higher court, may I suggest a higher level if the Supreme Court declines your appeal.
You can refer the case to the International Criminal Courts. Perhaps you could charge Rob Ford with Genocide and Crimes against Humanity? How about violating the Rules of War?
Collective Punishment? You might have something there because his appearance is fairly offensive. Hey, you've got to try everything, don't you?

Left wing Pinkos with an agenda will worry their prey so long as they get support from their pawns like Paul Magder.

Seems to me Ruby's office might be behind much of the perfidy and back stabbing in Toronto politics.

Typical Ruby! anything to keep his ugly mug in the news

Canada should have Political Action Committees.

Ruby is a part of the Ruling Class and does not want to see any of his power diminished by those he considers beneath him.

As for his 'Pro Bono' status. What garbage... obviously he is on his own personal political Jihad to attack Rob Ford and is using the veneer of working for someone else for free to hide his abject hate for everything Rob Ford stands for.

@vangrungy We do have PACs! They are called unions!

Ruby is an attention monger - anything to keep focus on himself.
He wants to be important again - maybe the NDP will want him !
Send him to Ottawa like Jack - be rid of him

fairness to all sides is let the legal procedures play itself out. both sides have that right

in the meantime nothing will change at city hall. city council runs the city and the mayor will continue to lose votes on issues. so what's really changed?

@Stug Wow, changed your tune! Try not to let the bitterness consume you Stug.

Stop the circus. It's over - and it should be. You lost - move on!

We want Ford, justice pervails and Clayton Ruby must not have any other cases, or be good enough to do something worthy as a lawyer - they say he used to be a good lawyer, but apparently no one else wants him to represent them or he's be doing it. Top lawyers don't hang on, and on to an issue that isn't even important. Get over your personal vendetta. Move on.

Mayors raise money for charity all the time, and they ask lobbyists and others who deal with the city. The only difference here is that Ruby and his friends thought they had an opportunity to have a mulligan on the last election. Sorry Clay.

Before the decision was announced, someone on NewsTalk 1010 was saying that Ford couldn't appeal unless both parties agreed to take it to the Supreme Court (presumably, the Supreme Court would also have to agree to hear the case). Does that mean Magdar and Ruby can't now appeal unless Ford agrees to it?
  11. proton posted on 01/25/2013 01:02 PM
I predict the Supreme Court won't hear the appeal
    1. nick posted on 01/25/2013 01:09 PM
@proton I agree. They will know that it's a vendetta and also realize that it is a nuisance lawsuit and make Ruby look stupider than he already looks.
    2. CoffeeCon posted on 01/25/2013 01:09 PM
@proton lets file a complaint against ruby for something, hypothetically something like a lunch meeting with that family member that he claimed on his taxes; see if we can get his license pulled. Send him into the toilet for a couple of years. It would be well deserved. Also, we could try and dredge up something on Magder, there's no saint there either.

Clayton Ruby, missed the point and lost. Would Clayton Ruby, loses his request to appeal to SCC, he could be found liable for slander and defamation, injurious falsehood, and professional misconduct. Ruby's reputation is on the line here~! The only reason for Ruby to attempt to vindicate himself is by making application to SCC. There is no reason for this law firm to continue there pursuit. Once OCA decided, that shall be final. I wonder whether Ford's lawyers could assert the application is vexatious and without merit, thereby paying Ford and all his legal fees. I also query whether Ruby took the case on a contingency basis, whereby is Ruby won, his invoice would be paid. whereas if Ruby was unsuccessful, Ruby's client would be obligated to pay Ford's legal fees. If I were Ford, I would seek full legal recourse against Ruby his client, to include slander injurious false hood. and.......
    Stay Tuned.

It is ridiculous to disrupt the business of Toronto based on such a minimal issue. Ruby is just out for political reasons. I assume the court ruling had Riby and Magder paying the legal fees for Ford.

What a farce this damned city is. The sum involved is about what, 1/4 of what Kyle Rae spent on the goodbye luncheon he threw himself? And it's about a thousandths of a percent of what the TCHC blew on the Peter Street shelter? And we are going to fritter away even more time and money on this farce? This should eliminate any doubt that this city has been run by a kabal of leftwing crackpots for years, with the support of crackpot residents, and they can't stand being denied what they see as their right to run the city as they say fit (and, like most socialists), line their pockets handsomely. I hope Ford runs again, and wins, and maybe these people will get the picture...the left is DEAD.

    Take a Hike Clayton Ruby!

Stop the Drama, let Toronto bloom, not gloom...
Is it personal attack or what?

Clayton Ruby, a perfect example of the old saying:
"Old lawyers never die, they just loose their appeal"

Clayton Ruby is a jackass and not a very competent lawyer

Mr Ruby, It must be tiring being an uber socialist hate monger. Do yourself a favour and hang up your hate hat. You have obviously been crushed as your petty childish hate monger attacks on our Mayor have completely failed. YOU SIR, MR Ruby are a loser.

I agree with most of the sentiment expressed here.. but I suspect the folks posting here are preaching to the choir. You know what, threatening to go to the Supreme Court is meaningless.. by the time it even gets there, Ford's term will be up. So, Ruby.. fill yer boots for all the good it will do.

I think a huge factor the 3 judges considered was the mess that would result in upholding the original decision. Appoint someone not elected by the people? Illegitimate mayor. By election? Lot of expense and effort to go through only to have Ford re-elected, and for what.. less than a year before the next election anyway. And finally, the extra divisiveness all this would cause.

Lefties, suck it up.. The PEOPLE put Ford in the mayor's seat. A cabal of lefties deciding they don't like who the people chose should not be the basis upon which a mayor gets put in office. You made us put up with socialist Miller for 2 terms.. You can put up with Ford for 1.

According to what was said on John Tory's show, Magder will now need to pay Fords legal bills and they will be substantial. Now the boot is on the other foot eh Ruby. I hope Magder is crushed into financial oblivion for his reckless scum sucking behaviour. For all I care he can rot in hell. Hey,,,, maybe his leftie friends will help him. Hahahahaha. Have a good sleep tonight Magder.

    That's 2 strikes against ruby's firm. 3 strikes and YOU'RE OUT!!!!

Love the way these leftist pieces of s*** can't stand the democratic process when they lose, only when they win.

let's not forget that guy mascarin that confidently predicted ford didn't have a chance. He's a lawyer at the same firm as another famous....wait for it....lawyer and former, ever so popular mayor, daviddddd millerrrrr.

what does it say about that law firm, especially after they took miller back after his brilliant career as mayor?

Rob Ford needs to be removed. He doesn't take his duties seriously and has caused Toronto embarassment in ridiculous farces that he refuses to take responsibility for. Even if Magder is after him for a personal vendetta, it would be insulting if Ford got away with so many blunders caused by his ignorance.
