A Toronto police officer has been charged with assault after an incident late last month.

32-year-old Const Gary Gould was responding to a call at a convenience store on Sunday, December 29th at about 5 a.m. Police say a 20-year-old man was acting unruly and had punched the clerk.

When police arrived, the suspect is accused of spitting on two officers, including Gould, as well attempting to break police property.

That is when police say Gould punched the man several times.

Const Gould has been charged with assault and is scheduled to appear in court next month. He faces a maximum penalty of dismissal.

This is not the first time the officer has been charged with assault.

Gould was off-duty in January of 2010 when he had been accused of assaulting a man outside a North York restaurant. The charges were dropped by the crown.
