The man who savagely beat and sexually assaulted a woman who was tending to her mother's grave at the Pine Hills Cemetery 4 years ago, has been declared a dangerous offender.
That means 48 year old Russell Kirkpatrick has no idea when he's allowed out of prison.
He'll be able to apply for parole in 2017, and every two years after that.
The justice presiding over the hearing agreed with two phsychiatric reports that indicated Kirkpatrick suffers from a personality disorder, alcohol abuse disorder, a preference for coercive non-concenting sex and remains a high risk to re-offend violently.
In court, Kirkpatrick called the claims 'bull s$%t'.
It was last year when he pleaded guilty to aggravated sexual assault and choking in the 2010 beating of a 61 year old woman.
In the attack she was choked unconscious, suffered a broken nose, jaw, orbital bone and suffered a brain injury.
