Another six months of freedom for Constable James Forcillo.
The Toronto police officer who is the only officer in Canada to ever be convicted in a shooting while on duty, will remain on bail until April of 2018.
It comes after a new evidence application was brought forward and accepted by the appeal court.
Forcillo was convicted of attempted murder in the death of 18-year-old Sammy Yatim, on a streetcar in Toronto back in 2013.
He shot the teen nine times in two seperate volleys of bullets.
Forcillo is free on bail, awaiting his appeal where his lawyers will argue that his conviction for attempted murder doesn't make sense and his sentence amounts to cruel and unusual punishment.
The former cop is looking for a new trial.
Forcillo was supposed to turn himself in, this coming Sunday, with the appeal set to begin on Monday.
The new evidence is a report by two doctors, can't be heard until April 3rd of next year.
That means Forcillo will have to surrender to authorities a day earlier.
In filing for the extension, it's also been revealed that Forcillo's marriage has broken down and he was granted a divorce from his wife, Irina, in July.
The two continue to live together and co-parent their kids, and she remains his surety while Forcillo is on bail.
