It was last year a Brampton man was caught on video literally pouring vodka down the throat of a woman he met in a nightclub.
Today, the 29-year-old was found guilty of sexually assaulting her.
Surveillance video shown from that night in July also caught the pair in a hotel elevator, the 25-year-old victim was slumped, stumbling, eyes barely open.
They had sex.
She told the court she barely remembered anything the next morning but did recall saying no more than once when he was on top of her.
Whether MoazzamTariq's advances were rejected or not the judge ruled the victim was way too drunk to give consent either way.
"Even though the accused didn't testify those same videos seem to show him acting and behaving just fine. He may have well consumed alcohol but there's a big difference between being a little bit tipsy, a little bit intoxicated and so drunk you've lost your capacity," says NEWSTALK 1010 chief legal analyst Edward Prutschi.
While the victim may have put herself in a position of becoming wasted at her friend's birthday party, Prutschi says that can never justify a free-for-all.
"The fact that someone put themself into a position where they became incapacitated might have been unfortunate, might have been stupid, might been something you want to criticize them for but it absolutely does not make that person subject of being taken advantage of."
