The province's special investigations unit says that Const. James Forcillo has been arrested after breaching conditions of his bail.
Forcillo was convicted with attempted murderĀ in relation to the shooting death of 18-year-old Sammy Yatim on a streetcar in 2013.
While he appeals the conviction, he has been under house arrest, and the SIU says he breached the conditions.
Forcillo was supposed to be staying with his wife, but defence lawyer Peter Brauti says the marriage has recently broken apart and his client was going to go to court this week to ask for his house arrest residence to be changed.
Brauti says the allegation is that Forcillo was caught at the proposed new address before it was legally switched over.
Forcillo has been charged with failing to comply with recognizance. He will be back in court later this week.
Criminal lawyer and legal analyst Boris Bytensky says that the Crown might show sympathy towards Forcillo given the domestic circumstances, but prosecutors might also ask to have his bail conditions tightened because he should have known better as a police officer.
