The Supreme Court has ruled that they will not hear the appeal from Jim Karygiannis, in his last ditch effort to save his seat on Toronto City Council.
That means he's run out of legal options to be reinstated on council.
It also means, it leaves the residents of Scarborough Agincourt without municipal representation, in the midst of a pandemic.
"I'm very seized of the fact that those people in that part of Scarborough need representation," says Toronto Mayor John Tory. He says they'll work quickly to declare the seat vacant, and decide whether or not to appoint someone to the post, or hold a byelection.
He was originally booted in November, when it was found he spent more money than he was allowed, during the 2018 municipal election.
Karygiannis claimed it was an honest mistake.
Because of the back-and-forth in the courts, this is actually the third time Karygiannis has been removed from office.
Adam Chaleff is the concerned citizen who has been fighting this through the courts, and he calls today "a good day for democracy."
"It was so glaringly obvious that he cheated and admitted that he cheated 11 months ago, Karygiannis should not have had the opportunity to sit at city council and continue to make decisions on behalf of residents, when he didn't deserve the seat on city council."
Karygiannis is barred from running in the next election, as penalty for this infraction.
But Chaleff says the fight isn't over either, with a compliance audit underway, which could see the former councillor facing fines.
"And if they find that this was a corrupt act in the way that he acted, to cheat, and he could actually face jail time."
When asked for a comment, Karygiannis pointed us to his website, where he'd posted a statement:
"After 32 years serving as your Member of Parliament and your Toronto City Councillor, I am leaving politics.
It has been an honour and privilege to serve the people of Scarborough-Agincourt. I want to thank them for the trust they have shown me.
I want to thank my family – my wife, daughters, sons-in-law and granddaughter– for their love and support over the years."
