A Toronto Police officer is headed back to trial on sex assault charges.
An appeal court on Monday threw out the acquittal and ordered a new trial for Sgt. Chris Heard.
He's the officers who was found not guilty last year on accusations he groped two women, in two seperate incidents in late 2015.
Both women were strangers to Heard.
In each case, the complainants claimed that Heard was on duty when he picked them up in the Entertainment District in his patrol vehicle.
The allegation was that he'd offer them a ride home and then grope them once they were in the passenger seat.
The trial judge concluded that the testimony from the two complainants was too inconsistent and therefore formed reasonable doubt that Heard assaulted them.
The ruling from the appeal court says that the trial judge did not properly consider how similar the women's stories are and that doing so might have led to a different outcome.
Officials with Toronto Police were not immediately able to confirm Heard's on-the-job status.
