Almost four years after the fatal shooting of 18-year-old Sammy Yatim on a downtown streetcar, Ontario's Special Investigations Unit has ordered a misconduct charge be laid against a Toronto Police sergeant who tasered the teen after he was shot eight times.
The Toronto Star reports that according to an investigaiton by the Office of the Independent Police Review Director Sgt. Dusan Dan Pravica used "unnecessary force" and "failed to assess the totality of the circumstances" as well as "acted in haste."
The order comes after a complaint made by Sammy Yatim's father Nabil Yatim to the OIPRD in October of 2013.
The lawyer for Pravica tells the Toronto Star he will plead not guilty to the charge.
No hearing date has been set.
And because of a six-month limitation on complaints at police disciplinary hearings, the Toronto police board will have to sign off on the charge for things to proceed.
Constable James Forcillo was found guilty of attempted murder in connection with the death of Sammy Yatim, who was killed July 27, 2013 in a shooting on a streetcar that prompted outrage about police use of force in the city.
Forcillo was sentence to six years in jail, he is out on bail pending his appeal.
