A 22-year old man faces a charge of failing to ensure the toddler in his passenger seat was properly secured.
An officer stopped the driver on Tuesday in the township of North Perth, near Kitchener.
Allegations are the 2-year old was sitting on a case of beer, which was being used as a booster seat.
The OPP says the toddler was not hurt.
Authorities brought the driver a booster seat that complies with provincial regulations, then called Ontario Family & Children's Services.
Police say they will not release the name of the accused in order to protect the identity of the child.
Road safety laws in Ontario state that a child weighing less than 40lbs. needs a car seat, while children weighing between 40lbs. and 80lbs. and under 8 years of age require a booster seat.
