The Crown is asking for 12 years in jail for the two men convicted of drugging and then repeatedly sexually assaulting a woman at the now-defunct College Street Bar in December 2016.
44-year-old Gavin MacMillan and 34-year-old Enzo DeJesus Carrasco we're both found guilty of gang sex assault and drugging to facilitate a sex assault last month.
Video footage showed the two men give the victim - who cannot be named because of a publication ban - cocaine and alcohol, before repeatedly committing sexual acts, which the defence argued were by consent.
However, the Crown succesfull argued it actually showed the men drugging and giving her alcohol until she was in and out of consicousness, before being overpowered into the acts for several hours.
Crown lawyers argued aggravating factors included that they committed the attacks on the woman in concert, that it went on for hours, that they were so much bigger than her, that it was recorded and because of their character.
For MacMillan who owned the bar, his lawyer submitted a sentence of 12 months if the judge agrees with his arguments and two years if he agrees with the Crown's facts.
For DeJesus who was a manager, the range was six months to also a maximum of two years.
The lawyers argued there were mitigating factors including no prior record, reference letters and family support.
One of the main arguments in sentencing was over the relevance of text messages between the two in the weeks leading up to the December 2016 assault.
The messages between DeJesus and MacMillan included references over getting footage from their security camera of women in the bar.
"Great ti*s and a big mouth is a good combination," said MacMillan in one message, to which DeJesus replied, "Ill try to find tge vid of her ti*s in the ice machine room."
"Beauty," MacMillan said in the next message.
"You better f***ing make it happen," DeJesus said to MacMillan in another, to which he replied, "Just ti*s. On camera. Bleeding b***h."
"We need another camera," another message said in an exchange over another woman.
The Crown argued these messages were relevant as showing a misogynistic character towards women, which countered the character letters.
But MacMillan's defense lawyer Sean Robichaud argued they were not relevant to the assault that occurred.
"We don't sentence people on their morality or sexual proclivities, we sentence people on crimes," he said.
With MacMillan appearing next to his lawyer while out on bail, Robichaud explained the decision to appeal the conviction based on a recent Court of Appeal decision on jury selection.
"He's always maintained his innocence," Robichaud said.
The sentencing hearing also included an emotional victim impact statement by the victim's mother.
"How can anyone hurt another human being like the way you did?" she said. "Did you stop to think what if this was your daughter, your mother, your sister, your niece, your granddaughter or even your friend?"
"Why wouldn't or couldn't you sto to think what this could do?"
Robichaud gave no comment about the statement and MacMillan didn't speak at all before leaving the courthouse.
DeJesus had bail revoked as he faces other charges of sexual assault involving other women.
