The victim of an apparent random stabbing attack at the Beaches International Jazz Festival that led to a charge of attempted murder, is surprised and worried that the accused has been granted bail.
"I'm definitely not happy about it and definitely concerned considering this guy lives just a couple of minutes away from me," Dylan Cann said regarding the release of 19-year-old Michael Jobe.
Cann was informed Friday at noon of Jobe's release the day before, but wasn't initially told about conditions.
The 27-year-old Cann said he's confused because the last he heard was the Crown was seeking a detention order for Jobe and the only update he had received was that he'd be back in court via CCTV for his next appearance.
The attack happened on July 25th when Cann said he was walking his dog at the festival, and a man approached and was irritated about the animal being there.
Cann said he left momentarily, but was grabbed and stabbed in the stomach and chest.
Jobe was eventually charged with attempted murder, as well as possession of a weapon and four counts of possession of a prohibited weapon.
His conditions include being on house arrest, having to be with his family at all times, no contact with the victim, not to be within 500 metres of the victim and no weapons.
NEWSTALK1010 Legal Analyst Ed Prutschi said the public should not be surprised.
"Bail is the default position in most circumstances," he said, adding many factors, such as age, mental health and release plans are involved in bail.
Prutschi later added however that the victim should've been informed of the plan as it was happening.
The discussion around stricter bail conditions and tracking of criminals has been in the spotlight in Toronto regarding gun crime, with Mayor John Tory pushing the prime minister for stronger guidelines.
But Cann said he can't help but feel worried.
"I'm definitely worried, I'm considering going away for a little while," he said. "All those internal muscles were cut right through, so they're going to take a while to heal up, but mentally I was doing better until I heard that this guy just got released."
