An Ontario court judge has reserved his decision on whether to dismiss a case against two former top Liberal aides without the defence putting forward any evidence.
David Livingston and Laura Miller, who were top aides to former premier Dalton McGuinty, are accused of illegally destroying documents about the government's decision to cancel two gas plants ahead of the 2011 provincial election.
Judge Timothy Lipson reserved a decision on a request for a directed acquittal after lawyers for Livingston and Miller argued the prosecution has failed to prove their guilt on charges of mischief and illegal computer use.
The prosecution last week admitted it had no case on a third charge against Livingston and Miller, breach of trust.
The pair will hear on Thursday whether they need to offer any further defence to the remaining accusations.
